It sounds like it's all just romanticized and vapid speculation.
Because this was early modern Europe, not fucking ancient times, people didn't have their heads chopped off for fucking stealing. This punishment was both cruel and unusual, he had to have been someone important, important enough that they couldn't or didn't want to simply kill.
