Model S was exceeding the speed limit at time of Tesla Autopilot accident. The car was traveling 9 mph over the posted limit at the time of impact. Tesla said the combination of a bright sky and white trailer might have made the truck difficult to see, After slamming into the side of the truck, the car rolled around 300 ft (91 m) before hitting a telephone pole. Having broken the pole, it then carried on another 50 ft (15 m) before coming to rest in someone's front yard.

You can't just put it in autopilot and go to sleep or stop looking at the road. The accident is still the fault of the driver (who was watching a Harry Potter DVD or something at the time).

the consumer has to go through menus and warnings that explain the dangers of it to enable the feature. It is not enabled when they get the vehicle.

Soccer moms get behind the wheels of 6000 pounds Suburbans and text, read books, do their makeup, or talk on their oversized phones which prevent them from having peripheral vision. This is just another step in retardation and while I don't agree with Tesla putting this out in their snarky Tesla way, it's laughable to say that this accident wouldn't have occurred at some point with or without autopilot.

you're never not going to have "the average retard" behind the wheel. ever. we live in a society where ancient people pressed and held "Start/Stop" thinking it was a radio button. A place where leaving a car in gear with no e-brake is considered the fault of the manufacturer. A place where having 20 pounds of keys on your keychain was somehow the fault of the company.

So while I don't like Tesla, and think the AutoPilot is stupid, there is no way to effectively learn and test this automated driving without using it en masse with the public. That public needs to take it seriously, but they won't, so you either make them sign their life away (which they did) or you just abandon the concept until you can secure autonomous-car-only-roads.

A consumer is explicitly warned. Then consciously accepts conditions and terms of agreement. Nowhere does it say "this vehicle is perfect and you will not crash with autopilot, do whatever you want" In fact it says manner other things which the USERS DON'T DO. Meaning it's their fault.

How do they know what he was watching, do Tesla's track the drivers viewing habits... what if I want to watch PORNO in my Tesla will they know.

I'm pretty sure it would work legally at least for a while especially if you did the stuff specifically to blind Teslas on your own without ever expressly stating that was your objective (you could say the IR floods for when you're using your night vision goggles to drive)
