Probably because the engine design it was based on was already compliant with emission regs or whatever whilst the BMW engine probably wasn't aiming for US regs during its drawing board cycle and simply found out later that they might've forgotten they couldn't do whatever it is they were doing during the EU design for the american market. would've costed too much to make a full conversion so simply de-tuning the engine was the easiest option.

Actually i heard the Viper had to also lose power when being sold in EU countries so its weird how countries go about conducting whats a clean or compliant engine for their unique environment.

Its always easier for a car to meet laws for its country of origin than an exporting country.
