The closest link disney has to warhammer is through FFG's X-wing miniatures game which is A) already outselling all of GW's stuff, B) a licensed thing so the mouse doesn't even get most of the cash, and C) produced by a company that ALSO has licenses with games workshop

GW knows they won't win a straight fight without substantial effort, but the mouse also doesn't want this fight, its easier to settle out of court with a token sum. That way GW doesn't have to defend its patent and neither company has to get involved in a fight neither wants.

1) Marvel doesn't give a shit about this stuff. The "talent" that they hire cribs, copies, traces, "references" and outright steals on a very regular basis. Due to the sheer volume of work they put out in a week they either never know, or when it is brought to their attention they write it off as an artistic "choice." I know this because I hate Greg Land on a personal level and used to bring every instance of his tracing to my boss...and every time they turned a blind eye because despite all decency in this world his shit moves units. Granted Ariel OIivetti is basically a nobody...and Marvel wouldn't mind tossing him under the bus to make a point...but they don't HAVE to do that because...

2) While GW might be notoriously quick to pull out their legal phallus against forums, websites and tiny one-man operations, there is very little chance that they would want to pick a fight with Disney, a corporation whose throbbing legal member would probably make them walk away believing they stole the Tau from Marvel.

I also dont play 40K but as far as I remember the space marine dude was running a white scar army where all of it starts the game in reserve since he figured the tau guy would have a normal tau gunline.
The Tau guy actually had a shitload of kroot which he infiltrated onto the marine guys side of the board so he wasnt able to bring anyone in and instantly lost.

It's from a few editions back, but it's a glorious moment

The dude in the white has a cheesy list where his entire army starts in reserve (off the table) and can "move" into the game on the enemy's starting side after the game begins, which is a pretty huge advantage - the enemy can't shoot them, and they get into combat faster.

The guy with the grin knew this tactic, and deployed his force - a few very big infantry units, with maximum spread between models - in such a way that the other guy's army has no eligible way to come onto the board. The army is defeated because it can't arrive, despite not a single unit being killed

Again. I don't disagree with you. This is half the reason I am a former Marvel employee (the other half is shit compensation). But due to a combination of being shielded by Disney and literally printing money in the film department Marvel definitely has the unique ability to not give a single fuck about something so trivial as some freelance shithead adhering to silly laws. Worst case scenario they burn Olivetti because he is not a Marvel employee and they continue going about their business.

But nothing will happen, because this is so trivial to both companies.
