Isn't it the point, that the same set of 4 tiles seems to have different area in those two arrangements?
Because in one it obviously has the area of a rectangular triangle with sides 5x13 and in the other arrangement it has less.

if they aren't similar the gradients of the hypotenuses are different, thus the big triangle isn't actually a triangle. If the two triangles were similar this wouldn't work.
