I mean the reason it's still referred to as an Empire is to make it easier for historians instead of calling it the Byzantine Empire during one time period and then the Byzantine State in the next.

It's called an empire because that's what it literally was. A state is an empire if it is an extension of the Roman imperium. The status of an empire is not dependent on a state's size or composition.

It was an empire because people considered it so, that's all there is to it.

Genoa Republic was a very expansive merchant Republic and would establish largely funded guilds in cities that would eventually take over the city council. After which they would pledge their loyalty to the Genoa Republic.
