MangaGamer is the publisher for some of the devs that had art traced. They sell some of their older titles on Nutaku. They could take legal action on the devs behalf.

And they can't really sue Nutaku, since they weren't aware. And as a rich company Nutaku will obviously have a huge team of professional lawyers at their disposal. Ignorance doesn't exempt people from following the law. They have the legal obligation of checking the images, since they've for all means and purposes purchased them.
Anyway, given that Nutaku is trying to become "the" market for adults vns, I'm pretty sure they'd rather remove the offending vn that risk becoming known as those people that allow such things to fly, given that it could potentially damage their relationship with future partners.
