Seriously, memes aside, was there a technical reason why Oblivion had items count as stolen the instant you TOUCHED them, so you were constantly "stealing" things by accident?
Could no one figure out how to program the game to detect whether you moved an item a certain distance or held it for a certain time? Or even just a popup message asking to confirm you want to steal an item?

They were probably too lazy to program it only counting after an amount of time or distance.
