The problem with fascism is that its presence in places like Italy and Spain are often overshadowed by Germany, so it often winds up being associated with right wing racism. Also the 14th Amendment is not consitutional. As only one CSA state ratified it pre certification and not under duress. the other CSA states rejected it. Some only ratified it before certification because they had their state governments suspended and under military occupation until they ratified.

Federal government passed the Reconstruction Act with out southern state legislators. It denied the southern states representation in Federal Government and put the state government under military control, until they ratified the 14th amendment.
