Life is Strange is an episodic interactive drama from DONTNOD Entertainment. Set in the Pacific Northwest in the town of Arcadia Bay, the player follows the story of Maxine Caulfield and her seemingly newfound ability to turn hella gay and rewind time. At the prestigious Blackwell Academy, Max must prepare with Chloe Price for the incoming storm of returning to her hometown after five years. Available on Steam, PSN and Xbox Live.
The name is irrelevant (and had already changed a few times anyway). The issue is that it's an IP infringing fan game, something Square Enix typically has a fairly hard stance against. And worse, it's a fan game designed to look/play exactly like a proper LiS game, and it is using models/textures ripped straight from the game. IP infringement on multiple levels.
An useful comparison is the Love is Strange fan game from shortly after Season 1's conclusion. It was a much smaller scale project, using a different style of game (visual novel), with its own unique art stye and content ... and the developers weren't running around being as obnoxious about it. It seemingly went under Square's radar during development, it had a very positive reception upon release, and that was that. Everybody wins, it's easy for Square to look the other way.
This new project is just several steps too far. And they know it, which is why part of the team abandoned, and the owner decided to convert it into a fan film (which Toby said Square was more lenient towards).

Square isn't doing anything to the game, at least not yet. All that happened was Toby got in touch with them to tell them that they probably would be C&D'd at some point in the future if they continued publicly working on it. This is seemingly what caused part of the team to jump ship, and the project lead to decide to change it into a short film.
The name is pretty much irrelevant, they had already changed it a few times, and based on the track record I would have been willing to bet that it would have changed a few more times as well.
I doubt Square Enix would care about the name itself. "After the Storm" is super cliche at this point, there's no way they'd name a Season 1 sequel that anyway.

The splinter group supposedly isn't doing anything Life is Strange related at all. I'm not sure whether it's because they don't want to lose a bunch of hard work because of a C&D, or whether they just have higher ambitions to make their own "proper" game ... but whatever the reason, they're out.

What a mess)

Yeah, a few folks were pretty annoyed because suddenly all the work they had already done was rendered useless.
I'm really not sure what the deal was with a lot of the behind the scenes stuff, but things just seemed to keep randomly changing. It certainly doesn't seem like the kind of project I'd want to be spending my free time working on, knowing that so much work could be suddenly flushed down the toilet simply due to poor organisation or the whims of the project leaders.
