IIRC There was a sentence by a German tribunal which declared that pornographic films weren't protected by author's right laws, which basically means they aren't art, legally speaking.

It is, but the vast majority of pornography is poorly produced and doesn't achieve anything of artistic value. I haven't checked it out but the School of Life is trying to produce porn as therapy and develop a better class of porn. That might hold some artistic integrity.
