Kobolds originally come from mythology iirc and have so many different interpretations i think kobolds are copyright free. Atleast i never saw WoTC sue Dwarf Fortress
No its public. They are also in wow and other fantasies
not to mention Pathfinder by Paizo publishing, so I'm *assuming* it's just a generic race at this point
Kobolds are mythology, which is inherently public domain. WOTC's take on them however is their interpretation and is their IP.

Not yet. We've been able to copyright genes for a few years now though, so I give it about 4 more years.
