Like could I make a board game and have a couple of cards associated with their race?
I know that something like a Beholder was entirely made up by D&D, but can you actually copyright mythology?

Kobolds originally come from mythology iirc and have so many different interpretations i think kobolds are copyright free. Atleast i never saw WoTC sue Dwarf Fortress

Kobolds are mythology, which is inherently public domain. WOTC's take on them however is their interpretation and is their IP.

Not yet. We've been able to copyright genes for a few years now though, so I give it about 4 more years.
